Summary

Pueblo allows one accessory dwelling unit by right on any lot zoned for a one-family residence, including qualifying PUDs, but caps its size at 800 square feet or the size of the main home, whichever is smaller.

One accessory dwelling unit is allowed as an accessory use to a one-family residence in any zone district where a one-family residence is allowed, including in any Planned Unit Development (PUD) Districts that allow one-family residences. A one-family residence includes a detached single-family dwelling unit and a manufactured home placed on a permanent foundation designed by a Colorado registered design professional, but excludes a two-family residence, townhouse, multi-family residence, mobile home, or recreational vehicle.

(b) The following standards apply to all accessory dwelling units.

(1) The owner of a lot must demonstrate occupancy of the lot when an application is submitted to construct a new accessory dwelling unit on a lot that already contains a one-family residence or to convert part of an existing one-family residence into an accessory dwelling unit. Proof of occupancy may include, but not be limited to, a computer-generated utility or medical bill, first-class mail, or bank statement that includes the subject property address and is dated within 12 months of applying to construct or convert an accessory dwelling unit.

(2) The accessory dwelling unit shall not be sold separately from the one-family residence on the same lot; nor shall the lot on which the accessory dwelling unit and one-family residence are situated be further subdivided or rearranged to create individual lots

Full Breakdown

Section 17-4-16(a) permits one accessory dwelling unit as an accessory use anywhere a one-family residence is allowed, including Planned Unit Development districts that permit one-family homes; it excludes two-family, townhouse, multi-family, mobile home, and RV lots. Subsection (b) caps the ADU at no more than 800 square feet or 100% of the primary home's gross floor area, whichever is less, limits a lot to one ADU, and sets height and setback rules: attached units follow the zone district's standard height and rear-yard setback, while detached units 16 feet or lower may sit as close as 5 feet from the rear line.

Violations & Fines

Building or converting an ADU that exceeds the size cap, adds a second unit, or skips required zoning review violates Chapter 4 performance standards, a municipal offense under Section 17-7-3.
