Garage conversion rules in Menifee, CA — sometimes called garage-to-ADU or accessory living unit conversions — govern permits, ceiling height, egress, and parking replacement.
Menifee Development Code §9.295.020 'Accessory Dwelling Units and Junior Accessory Dwelling Units' allows existing garage conversion to ADUs under Government Code §65852.2. The state preempts most local restrictions: cities must approve ministerially within 60 days, cannot require replacement parking when converting a garage to an ADU, and cannot require the converted space to meet ADU setbacks if it preserves existing exterior walls.
Menifee Development Code §9.295.020 (Article 5 Special Use Standards, Chapter 9.295 Special Housing Types) implements California's pro-ADU statutes for garage conversions. Under Gov. Code §65852.2(a)(1)(D)(vii), a city cannot require replacement parking when an existing garage is converted to an ADU — this is mandatory state preemption. Under §65852.2(e)(1)(A), conversions of existing space within a single-family dwelling or accessory structure (including attached or detached garages) must be approved ministerially without discretionary review, public hearing, or CEQA review. Existing setbacks may be maintained for the converted garage; new construction expanding the footprint requires 4-foot side/rear setbacks per §9.295.020. Menifee's ADU maximum is 1,500 sq ft of living space. Detached garage-to-ADU conversions can use the existing height; new detached ADUs are limited to 18 feet (or 20 feet within 1/2 mile of major transit, or 25 feet for attached). The city must approve or deny within 60 days under §65852.2(b). Development impact fees are waived for ADUs under 750 sq ft per Gov. Code §65852.2(f)(3). Utility separate metering is permitted but not required. Menifee offers a Permit Ready ADU program with pre-approved plans (studios 306-415 sq ft up to 3-bedrooms 988-1,198 sq ft).
Unpermitted garage conversions discovered during resale, refinance, or code enforcement may be required to either obtain after-the-fact permits or be returned to garage use. State law (Gov. Code §17980.12) allows owners to legalize substandard ADUs built before Jan 1, 2020 with limited code corrections. Operating an ADU as a short-term rental (under 30 days) is prohibited — Menifee §9.295.020 requires minimum 30-day rental terms.
