Summary

Unincorporated Lyon County caps every accessory building, including sheds and detached garages, at 30 percent of the lot's total area and layers setbacks by height: structures up to 15 feet follow the front setback, while taller buildings must meet the full principal-structure setback under Chapters 310 through 314.

These county ordinances apply to unincorporated areas of Lyon County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

2. Accessory Building:

a. Accessory building on lots less than two (2) acres:

(1) The total square footage for all accessory building footprints on a lot shall not exceed thirty percent (30%) of the total lot area provided all required setbacks are maintained.

(2) Accessory buildings shall not be located closer to an adjacent road than the principal structure. Exception - double frontage lots may place an accessory building to the rear of the principal structure so long as the principal building setback is met along the property lines adjacent to the street.

(3) Accessory buildings up to fifteen feet (15') in height shall meet the front setback requirements of the principal structure. The side and rear setback shall be no less than five feet (5'). Buildings greater than fifteen feet (15') in height shall meet the principal building setbacks listed in chapters 310 through 314 of this title.

Full Breakdown

Lyon County Code § 15.335.03(A)(2) splits accessory building standards by lot size. On lots under two acres, the combined footprint of every accessory building on the parcel cannot exceed 30 percent of the total lot area, and all required setbacks must still be maintained. An accessory building cannot sit closer to the adjoining road than the principal structure, though a double-frontage lot may place the accessory building to the rear of the house as long as the principal setback is held along the street-facing property line.

Height sets the setback tier: a shed or garage up to 15 feet tall only has to meet the principal structure's front setback, with side and rear setbacks no less than five feet, while anything taller than 15 feet must meet the full principal-building setbacks listed in Chapters 310 through 314 for the parcel's zoning district. Lots of two acres or more follow the same 30 percent coverage cap and the same 15-foot height break for setbacks, but gain an added carve-out: on parcels of five acres or larger, an accessory building may sit as close as 100 feet to a road instead of matching the house's setback.

Every accessory building, regardless of lot size, is also subject to the dimensional, impermeable-surface and structural coverage limits in Chapters 310 through 316, and the Community Development Department checks these numbers during the building permit review before a shed, garage or barn goes up.

Violations & Fines

Building an accessory structure over the 30 percent lot-coverage cap, inside the required setback, or closer to the road than the house without qualifying for the double-frontage or five-acre exception is a zoning violation. Lyon County Code Enforcement under Title 1 can issue a notice of violation, require the structure be moved, resized or removed, and assess civil penalties for continued noncompliance.

Frequently Asked Questions

How big can my shed be on a Lyon County lot under two acres?
There's no flat square-foot cap on a single shed, but every accessory building on the lot combined cannot cover more than 30 percent of the total lot area, and it must still clear all required setbacks under Lyon County Code § 15.335.03(A)(2)(a).
What setback does a 12-foot-tall shed need?
Because it's under 15 feet, it only has to meet the principal structure's front setback, with side and rear setbacks of at least five feet, not the full district setback tables in Chapters 310 through 314.
Can I build my garage closer to the road than my house?
Only on a double-frontage lot, where the accessory building can go to the rear of the house as long as the principal setback is held along the street side, or on a five-acre-plus parcel, where it may sit as close as 100 feet from the road.
