03, Parma's animal abuse ordinance, folds bird protection into its general cruelty provisions. 01(d) defines 'animals' to include all fowl. The only carve-out sits in division (i): pest control activities performed by individuals certified by the Ohio Department of Agriculture, persons under their direct supervision, another governmental agency, or property owners conducting pest control on premises they control. or Ohio Environmental Protection Agency, applied strictly according to label directions, and applied so they do not create a substantial risk of harm to non-target animals or birds.

Certified applicators and their supervised staff must also give advance notice of their pest control activities to the Animal Warden's office and dispose of resulting carcasses reasonably. 03 also bars offering a live animal as a prize, selling a prohibited animal, exposing poison where animals could eat it, and using spring steel traps other than for rats and mice, all under the same penalty structure. 03, including the bird-killing and nest provisions, is a misdemeanor of the first degree; the code escalates any subsequent violation to a felony of the fifth degree, among the steepest penalty jumps in Parma's animal code. The Police Division and animal control officers enforce the section under Ordinance 45-06, amended by Ordinance 157-11.
