Cedar Park prohibits keeping fowl (including chickens) and livestock within the city except in Equestrian Suburban (ES), Suburban Residential (SR), and Rural Agricultural (RA) zoning districts on lots one acre or greater. Most single-family residential lots are not eligible.
Under Code of Ordinances §2.05.002 (Keeping of Fowl) and §2.05.003 (Keeping of Livestock), Article 2.05 (Keeping of Domestic Pets, Livestock, and Fowl), no person may possess, harbor, or maintain fowl or livestock within the corporate limits unless on a lot or tract one acre or greater located in an ES, SR, or RA zoning district. Where fowl are permitted (ES/SR), they are limited to fifteen (15) total per lot, with no more than one (1) rooster. Fowl must be confined in a fully enclosed and ventilated or open-air cage, pen, coop, or enclosure providing a minimum of three (3) square feet of covered floor space per bird. All cages, pens, coops, or enclosures (for fowl or livestock) must be set back at least twenty-five (25) feet from any property line. "Fowl" is defined to include poultry, chickens, guineas, laying hens, turkeys, ducks, geese, pheasants, quails, and peacocks. "Livestock" includes horses, cattle, mules, goats, sheep, and miniature horses (and excludes dogs, cats, ferrets, gerbils, hamsters, mice, potbellied pigs, and rabbits). Texas state law (HB 2127, the "Death Star" preemption act, codified in Local Government Code Ch. 102A) does not displace municipal zoning authority over animal keeping.
Per §1.01.009 (general penalty) referenced by Chapter 2 enforcement, violations are Class C misdemeanors punishable by a fine not exceeding $500 (or up to $2,000 for public-health/sanitation related violations). Each day a violation continues is a separate offense. Animal control officers are authorized under §2.05.004 to impound non-compliant fowl or livestock; owners are responsible for all impound, transportation, medical, boarding, and feeding fees prior to release.
