New York City does not require pet owners to spay or neuter dogs and cats. Sterilization is mandatory only for animals leaving city shelters under New York State Agriculture and Markets Law §377-a. DOHMH and ACC fund voluntary low-cost mobile clinics for residents.
Unlike Los Angeles, NYC has no general spay/neuter mandate for owned pets. The only legal requirement is shelter-based: under New York State Ag & Markets Law §377-a, no dog or cat may be released from a public shelter or rescue without sterilization or a deposit guaranteeing it. Animal Care Centers of NYC, the city's open-admission shelter contractor, sterilizes every dog and cat before adoption. DOHMH partners with the ASPCA, the Mayor's Alliance for NYC's Animals, and Humane Society NY to operate free or low-cost spay/neuter clinics, plus a mobile ASPCA spay/neuter van that visits low-income neighborhoods on rotation.
There is no fine for keeping an unaltered owned pet in New York City. Shelters and rescues, however, cannot transfer an unsterilized dog or cat to an adopter without violating Ag & Markets Law §377-a.
