Summary

(e)All certificates or renewals thereof required to be obtained under this section shall only be issued to persons 18 years of age or older who present satisfactory evidence: (i) of the animal's current rabies vaccination, if applicable, and (ii) that the animal is and will be confined in a proper enclosure or is and will be confined inside the owner's residence or is and will be muzzled and confined in the owner's fenced-in yard until the proper enclosure is constructed. In addition, owners who apply for certificates or renewals thereof under this section shall not be issued a certificate or renewal thereof unless they present satisfactory evidence that: (i) they possess a current city dog license, (ii) their residence is and will continue to be posted with clearly visible signs warning both minors and adults of the presence of a dangerous dog on the property, (iii) the animal has been permanently identified by means of a tattoo on the inside thigh or by electronic implantation, (iv) will cause the animal to be spayed or neutered, and (v) will purchase liability insurance coverage of at least $100,000.00.

Under Sec. 1, a canine is legally a "dangerous dog" once a Portsmouth general district court finds it has bitten, attacked, or injured a person or another animal. Within 45 days of that finding, the owner must obtain a dangerous dog registration certificate from the city treasurer and pay the fee set out in appendix A to the Code; the certificate must be renewed every year by January 31. 00. While on the owner's property the dog must be confined indoors or in a locked enclosure at least six feet high; off the property it must be leashed and muzzled.
If the owner is a minor, the custodial parent or guardian answers for compliance instead. Owners must notify animal control immediately if the dog gets loose, bites again, is sold or given away, or moves to a new address.
