Hutto, TX Animal Ordinances: Pet Limits (2026)

Unlike a headcount ordinance, the City of Hutto does not cap pet ownership at a specific number of dogs or cats per household. Section 4.01.008, titled "Keeping of numerous animals," applies a nuisance-based standard: it is unlawful to keep animals within the city "of such a number that the animals constitute a public nuisance or menace to public health or safety." Chapter 4's definitions section reinforces this approach, listing as a nuisance any animal that is "offensive or dangerous to the public health, safety or welfare by virtue of the number of animals maintained at a single residence or the inadequacy of the facilities." Section 4.07.002 applies a parallel standard to sanitation, making it unlawful to permit waste to collect so as to "cause or create an unhealthy, unsanitary, dangerous or offensive living condition," and section 4.07.003 ties that same test to the "size or number of animals maintained at a single location." In practice, an animal control officer investigates complaints, such as noise, odor, or accumulated waste, and decides whether the number of animals on a property has crossed into nuisance territory given the facilities available, rather than counting heads against a fixed limit.

Because chapter 4 sets no specific fine for section 4.01.008, a conviction falls under the citywide general penalty in section 1.01.009, capped at $500, and section 4.01.004 makes each day the nuisance continues a separate offense.
