Kyle, TX Building Safety: Building Permits (2026)

Section 8-2(a) prohibits the city from issuing a building permit, certificate of occupancy, plumbing permit, electrical permit, or utility tap for any lot unless the work complies with Chapter 8, the applicable zoning provisions, and the applicable subdivision provisions. Section 8-1(d) separately makes it an offense, punishable by a fine of up to $2,000.00 with each day a separate violation, to occupy any building or part of one without having received a certificate of occupancy, on top of any penalty for the underlying construction violation.

Section 8-23(a) adopts the International Building Code, 2021 Edition, including Appendix Chapters C, E, F, I, J, and K, as the designated building code of the City of Kyle, with § 8-23(c) applying the most restrictive provision if it conflicts with another part of the city's code. Enforcement is not limited to fines: § 8-2(b) allows civil injunction and other civil or criminal proceedings in addition to any other remedy, and § 8-2(c) lets the city council direct the city attorney to sue in district court to enjoin a violation, obtain a declaratory judgment, and recover court costs, attorney fees, and the cost of bringing the property into compliance.

Applicants seek the permit under § 8-46's written application process and must be a registered contractor under § 8-48 unless working on their own homestead, and § 8-104 doubles fees for work started before the permit issues.
