Lincoln County, SD Building Safety: Building Permits (2026)

Section 151.01 adopts, by reference, the most recent edition of the Uniform Building Code published by the International Conference of Building Officials as the county's official building code, with a printed copy kept on file in the Office of Planning and Zoning under SDCL § 7-8-20 authority. Section 151.03 then directs every application for a building or zoning permit required by the zoning regulations, subdivision regulations, or building codes to the Planning and Zoning Director or the Building Inspector, whichever the Board of County Commissioners designates to handle it.

Section 151.04 makes payment a precondition of issuance: no building or zoning permit may be issued unless the applicant pays the fee the Board of County Commissioners sets by resolution, at the time of application. Later-adopted code editions layer on more specific permit mechanics: the IRC amendments at § 151.33 require an application to the building official under R105.1 for any regulated construction, alteration, or system installation, list narrow work exemptions at R105.2, and set a 365-day permit validity period at R105.S. The Planning and Zoning Director, acting as Building Inspector under § 151.02, is responsible for enforcing these permit requirements and inspecting the resulting work for compliance with the adopted building code.
