D. Child Day Care Facility Development Standards. Small family child day care homes are considered a residential use of property and shall be a permitted use in all zones in which residential uses are permitted. Day care centers are subject to the approval of a Conditional Use Permit in compliance with Section 9-2.1101 of this Code. Section 9-4.103, subsection D, sets the Huntington Park rules for child day care. A small family child day care home, defined in Section 9-1.203 as a home providing family day care for eight or fewer children, is a residential use and is permitted in every zone where residential uses are permitted. A large home must meet the property development standards of its zone, cannot sit within 300 feet of another large facility unless the existing one is filled to capacity, offers different services or the area has a high need, must follow the sign standards of Section 9-3.1201, and must be State-licensed and operated under State Health and Safety regulations. The application and processing fee is $100, separate from the business license and the Home Occupancy Inspection. Where affected persons within a 100-foot radius make substantiated noise complaints, the City can require a six-foot solid decorative fence or wall and on-site landscaping. In the front yard the fence is a maximum of 60 inches with 80% visibility, and a solid front-yard fence or wall is a maximum of 36 inches.
The Director has 30 days to decide whether an application is complete and 30 days after that to grant or deny it, and must give affected persons at least 10 days notice before granting. A denial can be appealed to the Planning Commission within 15 days, and a Commission decision to the City Council within 10 days. Parking under Section 9-3.804 is no additional spaces for a small home and 2 spaces for the primary residence plus one for loading and unloading for a large home.
Violations & Fines
The Director can revoke or modify a Large Family Child Day Care Home Permit after a hearing noticed at least 10 days ahead. Grounds include 14 days of written notice of reasonable-basis complaints that the operator would not correct, a permit obtained by misrepresentation or fraud, unmet conditions of approval, noncompliance during the prior 12 months, or a use that violates any statute, ordinance, law or regulation.
