Monterey Park, CA Building Safety: Childcare Center Rules (2026)

Section 21.08.040(B) sets the physical safety standards that apply once a Monterey Park residence is licensed to care for eight to 14 children, on top of any state licensing requirement. The outdoor play area must measure at least 75 square feet per child and never less than 450 square feet total, must include play equipment, and must sit in the rear yard, since stationary play equipment cannot be placed in a required side or front yard. That play area must be secured by a six-foot-high solid decorative fence or wall on all side and rear property lines, built with materials, textures, colors, and design compatible with the home and its neighbors, and designed with controlled points of entry for safety.

The garage cannot double as daycare space or as part of the outdoor play area. Operating hours are capped at 14 hours a day, with outdoor activity restricted to between 8:00 a.m. and 8:00 p.m., and all on-site lighting must be stationary and directed away from neighboring properties and the public right-of-way. Fire safety is written directly into the zoning section: the facility must contain a fire extinguisher and smoke detector devices and meet every standard in the California Fire Code as adopted by the municipal code.

The City Planner conducts an initial on-site inspection before the facility can operate and an annual inspection after that to confirm continued compliance, independent of whatever inspection schedule the state licensing agency runs.
