For the purpose of safeguarding persons and property from hazards arising from the use of electricity, the entire 2023 edition of the National Electrical Code is hereby adopted as promulgated by the National Fire Protection Association, including any amendments that have been or may be made by the State of Utah. The National Electrical Code, as adopted above, is hereby fully incorporated as if set out at length herein, and from the effective date of this Chapter the provisions thereof shall be controlling within the corporate limits of the City. ... Notwithstanding this subsection (5), no bond is required if the affected Building is one Single Unit Dwelling and the general contractor is also the Owner or builder of the Building. Full Breakdown
West Valley City has no homegrown electrical code: § 16-5-101 adopts 'the entire 2023 edition of the National Electrical Code' as promulgated by the National Fire Protection Association, 'including any amendments that have been or may be made by the State of Utah,' and makes it 'fully incorporated as if set out at length herein,' controlling within the City's corporate limits from the chapter's effective date. That adoption section has been amended repeatedly since 1990, most recently by Ordinance No. 25-04 on April 8, 2025, keeping the City on the current NFPA edition rather than an older one.
Under Utah Code § 10-3-711, a copy of the adopted NEC must sit in the City Recorder's Office for public examination both before adoption and continuously afterward. ' The Building Inspection Division of the Community and Economic Development Department administers both the NEC adoption and the permit process, and Title 16's general enforcement chapter makes a violation of the adopted Code a Class B misdemeanor, with each day of continuing violation a separate offense (§ 16-8-203).
Violations & Fines
Electrical work performed without a permit, or that fails a required panel and wiring inspection, is enforced under Title 16's general penalty section, § 16-8-203, as a Class B misdemeanor, with every day the violation continues counted as a separate offense. The Building Inspection Division may also withhold release of permanent electrical power to a structure under § 7-1-108(5)(a) until the drywall and electrical inspection passes, and may suspend or delay any related permit if an inspector is refused entry under § 16-8-201.
