Construction noise gets its own subsection, and its own rules, within the Specific Noise Prohibitions of Section 24-22-108. and plainly audible at the property boundary of the work site. But Section 24-22-108(7)(b) expressly turns off the 50-feet-at-any-time test that applies to most of the chapter's other prohibited acts; construction equipment is instead measured against Section 24-22-108(7)(a), which sets the threshold as the sound level limits for a manufacturing zone under Section 24-22-109, regardless of what zone the work actually sits in. , measured at the property boundary, with an added five-decibel reduction if the equipment emits a pure tone or a cyclically varying or repetitive impulsive sound under Section 24-22-109(3).

The rule expressly applies "irrespective of whether such construction actually occurs within the corporate limits of West Valley City," reaching noise that crosses in from an adjoining project. A contractor who needs to run equipment outside these limits, for an emergency repair or a time-sensitive job, can seek a waiver from the Director of the Salt Lake Valley Health Department under Section 24-22-112 on a showing of undue hardship or for a temporary event.
