Summary

Modesto's Fire Code amendment requires an automatic fire sprinkler system in any new building or structure where the fire area exceeds 5,000 square feet, regardless of use or occupancy. Condominiums and apartment buildings up to four stories can meet this with an NFPA 13R system and full attic protection instead of full NFPA 13 coverage. The rule took effect January 8, 2026 under Ordinance No. 3802-C.S.

1. An approved automatic fire sprinkler system is required in all new buildings and structures constructed on or after the effective date of this ordinance, notwithstanding the use and occupancy thereof, when any fire area, as defined in the California Fire Code exceeds five thousand (5,000) square feet. ... e. CFC 901.4.4 may not be exercised to add fire walls to avoid the installation of fire sprinklers in new buildings or to existing buildings during remodel/ addition. 2. Condominium /apartment buildings up to four (4) stories may be approved with NFPA 13R fire sprinkler systems with full attic protection. ... 4. Existing buildings and structures shall have approved automatic fire sprinklers installed when any of the following exist: a. When doing a remodel or addition the value of additions, alterations or repairs that exceed fifty (50) percent of the current county assessed valuation for improvements only in the existing building or structure that exceeds five thousand (5,000) square feet.

Full Breakdown

207 adds Section 903 to the adopted 2025 California Fire Code. Fire area calculations include every floor, mezzanine and basement, plus any attached projection greater than four feet, and structures within six feet of each other, or connected by a breezeway or covered walkway, have their floor areas aggregated when deciding whether the 5,000-square-foot trigger is met. Buildings three stories or taller require sprinklers no matter their height, and any Group A occupancy is covered outright. 4, which normally lets a designer add fire walls instead of sprinklers, may not be used to avoid installing sprinklers in new construction or during a remodel or addition.

Condominium and apartment buildings up to four stories may instead use an NFPA 13R system with full attic protection, meaning quick-response sprinklers spaced through the attic, hydraulic calculations based on flowing at least four sprinklers, and listed steel piping (listed CPVC is allowed only under attic insulation with special application heads). Every system needs an interior warning device approved by the Fire Chief. Retrofits apply to existing buildings too: if a remodel or addition's value exceeds fifty percent of the current Stanislaus County assessed valuation of the building's improvements and the structure exceeds 5,000 square feet, or if the remodel itself pushes the building over that threshold, sprinklers must be installed. The section states it cannot be read to lower the protection already required under the California Building Code.

Violations & Fines

Building without required sprinklers is caught at plan check and inspection by the Building Safety Division and Fire Prevention Bureau; occupancy can be withheld until the system is installed and approved. Because Section 903 is adopted into the Municipal Code, a violation defaults to the citywide penalty in Section 1-2.01: a misdemeanor punishable by up to $1,000 and up to one year in county jail, or an infraction up to $500, at the City Attorney's election, with each day of noncompliance treated as a separate offense.

Frequently Asked Questions

Does adding a room to my house trigger a sprinkler requirement?
Only if the addition's value tops fifty percent of the current Stanislaus County assessed valuation of the existing building's improvements and the structure exceeds 5,000 square feet, or if the addition itself pushes the total floor area over 5,000 square feet. Smaller remodels that stay under both thresholds are not required to add sprinklers under Section 3-1.207.
Can a fire wall be used instead of installing sprinklers?
No. Section 3-1.207 specifically states that CFC 901.4.4 may not be exercised to add fire walls in place of sprinklers, whether in new construction or during a remodel or addition to an existing building in Modesto.
What sprinkler system can a four-story apartment building install?
Condominium and apartment buildings up to four stories may use an NFPA 13R system with full attic protection instead of a full NFPA 13 system, provided the attic has quick-response sprinklers, hydraulic calculations for at least four heads, and listed steel or protected CPVC piping.
