The 2021 edition of the International Energy Conservation Code of the International Code Council, as hereinafter amended, is from the effective date hereof herby adopted as the energy conservation code of the city. Section R402.4.6 requires electrical and communication outlet boxes in the building thermal envelope to be sealed, tested to NEMA OS 4, with an air leakage rate of not greater than 2.0 cubic feet per minute (0.944 L/s) at a pressure differential of 1.57 psf (75 Pa), and marked "NEMA OS 4" or "OS 4". For R2 multifamily buildings with eight or more testing units, Sections R402.4.1.4, R403.3.8 and R403.6.4 allow sampling: the greater of seven units or 20 percent of the testing units, including a top floor unit, a ground floor unit, a middle floor unit, and a unit with the largest testing unit area. Each tested unit that fails adds three more units, and buildings with fewer than eight testing units test every unit. In the residential code, § 10-172 deletes Chapter 11 [RE] Energy Efficiency in its entirety and replaces it.
The building official enforces the adopted codes (§ 10-53), and the Building Codes and Standards Board hears appeals on the International Energy Conservation Code under § 10-79.
Violations & Fines
Violations are punished under § 1-14: a fine not exceeding $500.00 where no specific penalty is provided, with a maximum fine not exceeding $2,000.00 for provisions governing fire safety, zoning, or public health and sanitation. Each day a violation continues is a separate offense under § 1-14(c). The Building Codes and Standards Board has no authority to waive any requirement of the energy code (§ 10-79(b)).
