Brevard County LDC limits residential structures to 35 feet / 2.5 stories in most single-family zones. Beachside commercial and high-density zones allow taller. CCCL coastal zone has additional wind-zone height considerations.
Brevard County Land Development Code Chapter 62 regulates maximum building heights by zoning district. Single-family residential (SR, RU-1-7, RU-1-11, RU-1-13): 35 feet or 2.5 stories, whichever is less, measured from average finished grade to the highest roof point. Chimneys, antennas, and mechanical equipment generally exempt up to an additional 10 feet. Beachside resort/tourist commercial (TU, BU-1-A): up to 75 feet with site plan approval. Multi-family (RU-2-15, RU-2-30): 45-60 feet. Florida Building Code wind load requirements (140-150 mph zone for Brevard) affect taller structures. Space Coast tower ordinances also limit near KSC/CCSFS/MLB airspace. Height variances require Planning & Zoning Board hearing.
Exceeding height limit: stop-work order, reduce height or obtain variance. Fines $250-$2,500. FAA/airspace violations near airports: federal penalties additional.
