Newport Beach Zoning Code (NBMC Title 20, Chapter 20.30) establishes maximum building height limits by zoning district. In single-family residential (R-1) zones, the maximum height is generally 24 feet for flat roofs and 29 feet for sloped roofs (minimum 3:12 pitch). Multi-family residential zones allow heights of 28 to 32 feet depending on the specific district. Commercial zones permit heights ranging from 26 to 32 feet, with some Planned Community districts allowing taller structures through specific plan approvals. Height is measured from established grade to the highest point of the structure, including rooftop equipment, elevator shafts, and mechanical penthouses unless specifically exempted. Chimneys, vents, and antennas under certain heights may be exempt from the height measurement. The city's view protection policies are among the most significant drivers of strict height enforcement. Newport Beach has adopted view equity principles that limit structures from unreasonably obstructing views of the ocean, harbor, and surrounding ridgelines. Modifications to allow additional height require approval from the Planning Commission through a modification permit process that includes neighborhood notification and a public hearing. Properties in the Coastal Zone are subject to additional height review under the Coastal Land Use Plan. Rooftop decks and guardrails count toward the maximum height.
Building permits will not be issued for structures exceeding height limits without an approved modification. Unpermitted construction exceeding height limits is subject to stop-work orders and mandatory correction. Fines for height violations start at $500 per day of non-compliance.
