" The phrasing means a building can exceed 35 feet if that is what two and a half stories actually requires, and conversely a shorter but taller-per-story design is capped once it reaches thirty-five feet or two and a half stories, whichever limit is more generous to the builder. Subsection (b) immediately narrows what counts against that cap: "The height regulations of this chapter shall not apply to ornamental towers and spires, chimneys, smokestacks and flag poles," so those features can rise above thirty-five feet without a variance.

The same section also sets R-5's other dimensional standards in one place: a minimum lot area of 3,000 square feet per dwelling, a front yard of not less than twenty-five feet measured from the edge of the road, side yards of not less than ten feet (treated as a rear yard where they abut an R-1 or R-3 district), and a rear yard of not less than twenty feet. 09 adds an extra layer next to lower-density neighbors: no six-family structure within 150 feet of an R-1 or R-2 district, no other structure except garages and accessory buildings within fifty feet of an R-1 or R-2 district, and a required six-foot screening buffer of shrubbery, trees or a decorative fence within the twenty-foot minimum setback abutting those districts.
