Section 34-136 grew out of city council and planning board hearings that relied on Chelsea Police Department reports and secondary-effects case law, including City of Renton v. Playtime Theaters and City of Erie v. c. 40A, § 9A). The findings single out property crime, prostitution, public intoxication, obscenity and gang activity as the harms the permit process targets, and the council concluded the BH and SC districts, with their lighting, police proximity and public visibility, are more appropriate than the city's industrial zone or any residential area.

An applicant must first obtain a special permit from the zoning board of appeals and, per § 34-217, file 17 copies of a site plan prepared, stamped and signed by a professional engineer licensed in Massachusetts, along with the legal owner's name and address, everyone holding a direct or indirect ownership or security interest, and the operator's name and residential address. The permit term is capped at five years, with renewal requests due at least 180 days before expiration; filing a renewal keeps the establishment operating until the board acts. '
