Chelsea, MA Business Licensing & Operations: Tobacco Retail License (2026)

E of Chelsea's tobacco regulation limits eligibility to owners of a permanent, indoor, non-mobile location in the city, and requires proof of a current Massachusetts Department of Revenue Tobacco Retailer License before the Board will issue its own permit. The Board sets the permit fee annually and conditions every permit on the holder's consent to unannounced inspections; interfering with an inspection is itself a violation. Chelsea caps the number of active Tobacco Product Sales Permits at 42 citywide, and that ceiling only ever shrinks: whenever a permit is surrendered, revoked or not renewed, it is permanently retired and the total allowable count drops by one, so the cap can fall over time but never rise back up.

A permit holder who sells a business may transfer the permit to the buyer, bypassing the cap, but the buyer must apply for the transfer within 30 calendar days of the purchase, cannot sell tobacco until the Board approves the transfer, and must first clear any fines or suspensions left by the previous owner. Retail-density rules layer on top of the cap: no new adult-only retail tobacco store may open within 25 feet of an existing tobacco-permitted retailer, and the Board cannot issue a permit for a new retail location within 500 feet of a public or private elementary or secondary school, measured property line to property line.
