Full Breakdown
Sec. 110-5 requires a license, issued by the city, before an adult establishment may be operated or maintained in the city, and a separate license is required for each fixed location; no license may be transferred. Applicants, including every partner, officer or director of a corporate applicant, must submit fingerprints, photographs, ten years of residential and employment history, and disclosure of any prior adult-establishment license revocation. No individual applicant, corporate officer, or partner may hold a license if convicted of, or pleading no contest to, a felony or any crime involving moral turpitude, prostitution, obscenity, or another sexually related offense within the five years before the application, or if found to have previously violated Sec.
110-5 within that same five-year window. The police department must investigate every applicant and report in writing within 14 days, while the health, building inspection, and planning departments separately inspect the premises and report compliance within 14 days. Licenses expire December 31 each year and must be renewed through the same application process. Physical layout rules require any private viewing booth to be open on one side to a lighted public aisle, built with light-colored, nonabsorbent walls at least six feet high, and lit to at least ten footcandles when unoccupied, and only one person may occupy a booth at a time. Suspension or revocation requires written notice and a hearing before the license committee.
Violations & Fines
Anyone found to have violated Sec. 110-5, including an operator responsible for an employee's violation, faces a fine of up to $1,000 per violation, and any violation continuing more than 24 hours counts as a separate offense. The common council may also suspend a license for up to six months, revoke it, or decline to renew it after written notice and a hearing before the license committee, and a licensee whose registration is revoked cannot reapply for the same license type.
