Doña Ana County, NM Business Licensing & Operations: Adult Entertainment (2026)

Section 350-502B(9) of the Unified Development Code singles out adult bookstores and adult entertainment as uses that cannot simply open where the underlying zone otherwise allows retail or entertainment. Instead, the code imposes a 1,000-foot buffer measured from the property line of any church, school, public park or recreational facility, residential zone, or residential use, effectively pushing these businesses toward the county's more isolated commercial or industrial corridors away from neighborhoods and gathering places. On top of the distance standard, the provision requires a public hearing before the Planning & Zoning Commission (P&Z) before such a use can be established, meaning it cannot proceed as a by-right use even in a zoning district where similar retail or entertainment uses are otherwise permitted outright.

That hearing gives neighboring property owners and the P&Z a chance to weigh in on the specific site before the county allows the use to move forward, functioning as a case-by-case check layered on top of the fixed spacing rule. Because the standard is written into the general-to-all-zones article of the Unified Development Code, it applies everywhere in unincorporated Doña Ana County regardless of the base zoning district's other permitted uses. Las Cruces, Sunland Park, Mesilla and Hatch are separate incorporated municipalities that regulate adult businesses under their own codes, not this county provision.
