Fountain Valley, CA Business Licensing & Operations: Adult Entertainment (2026)

Chapter 4.37 of the Fountain Valley Municipal Code regulates sexually oriented/adult businesses in the City of Fountain Valley. Section 4.37.010 states the purpose: preventing secondary effects such as falling property values, crime, litter, noise and blight, without limiting the content of any material. Under 4.37.040 the owner must obtain and keep in force both the adult business permit and a business license, and 4.37.050 makes the owner the only person eligible.

The application goes to the license collector (4.37.060) with a form signed by the owner and the record property owner under penalty of perjury, a nonrefundable deposit or processing fee plus a permit administration fee set by City Council resolution, a site plan and a dimensional interior floor plan. The license collector sends it to police, fire and planning, and must approve or deny within thirty city business days of a complete application, mailing written notice within three city business days of the decision (4.37.070).

Section 4.37.080 sets the approval standards. The business must be in a zone or specific plan area that permits it and comply with any distancing restrictions that apply; the chapter itself lists no footage figure. It cannot be in a portable structure and cannot offer massage, acupuncture, tattooing, acupressure or escort services. A business that lets customers stay on site must have a uniformed, licensed security guard outside whenever it is open, plus a second guard inside if the occupancy limit exceeds fifty persons. Exterior windows need opaque covering, the grounds must be lighted, patron areas must be lit to at least twenty footcandles, and all patron areas except restrooms must be open to view. No one under eighteen is allowed, and hours are limited to eleven a.m. through nine p.m. except for adult hotels.

A permit is valid one year (4.37.100), renews year to year (4.37.110), cannot be transferred and is valid only for the exact location named (4.37.120). Section 4.37.140 separately requires an employee license for nude model studio, sexual encounter establishment and live performer employees.
