Summary

Gainesville won't let a sexually oriented business open within 1,000 feet of another sexually oriented business, a school, a place of religious assembly, a public park, a youth association, or a residential zoning district. On top of that zoning spacing rule, the business also needs a separate adult performance establishment or escort service license from the city manager.

C.Spacing. A sexually oriented business may not be established in any permitted district unless all other requirements of the chapter pertaining to such districts and to buildings generally are met and unless the sexually oriented business is at least 1,000 feet from any other sexually oriented business, place of religious assembly, public school, private school, public park, youth association or residential area.1.Measurement. For purposes of the spacing requirements, the measurement shall be made by extending a straight line from the nearest property line of the sexually oriented business to the nearest property line of the other sexually oriented business, place of religious assembly, public school, private school, public park, youth association or residential area.

Full Breakdown

25, adopted through Ordinance No. 190292 and carried forward through 2023 amendments. Subsection C bars a sexually oriented business from any permitted district unless it clears every other district and building requirement and sits at least 1,000 feet from any other sexually oriented business, place of religious assembly, public school, private school, public park, youth association, or residential area. 1. 2 exemption; it is not retroactively shut down. Beyond the zoning buffer, sexually oriented cabarets and motion picture theaters carry their own design standards in subsections F and G, including a minimum 600-square-foot presentation area with no curtains or partitions blocking the view.

5-63 runs through a background disclosure and a nonrefundable fee, and the city manager must grant or deny it within 30 days. Together the two chapters mean a Gainesville sexually oriented business has to clear both a zoning distance test and a separate licensing gate before it can legally operate.

Violations & Fines

Operating a sexually oriented business that fails the 1,000-foot spacing rule, or without the required adult performance establishment or escort service license under chapter 14.5, is a zoning and licensing violation. The city manager may suspend a license for uncorrected code violations, and repeat convictions for offenses tied to the business escalate a license suspension from 30 to 90 to 180 days before revocation under sections 14.5-70 and 14.5-71.

Frequently Asked Questions

How far must a Gainesville adult business stay from a school or church?
At least 1,000 feet, measured in a straight line from the business's nearest property line to the nearest property line of the school, place of religious assembly, public park, youth association, or residential area, under Land Development Code section 30-5.25(C).
Does zoning distance replace the need for a business license?
No. Meeting the 1,000-foot spacing test only satisfies the Land Development Code. The business separately needs an adult performance establishment or escort service license from the city manager under chapter 14.5, article IV, which involves its own application, background disclosures, and fee before opening.
What happens if a school moves in near an existing adult business later?
The business keeps operating as a permitted nonconforming use under section 30-5.25(E). If it was lawfully open, in operation, and code-compliant before the school, park, or residential area arrived within the buffer, the later arrival does not force it to close or relocate.
