Sec. ch. 569. Sec. 5-16 defines 'self-service merchandising' as open display of tobacco products the public can access without a vendor, storeowner or employee stepping in, and 'vendor assisted' as sales where the customer has no access without that assistance. Sec. 5-17 is the operative rule: no person, business, tobacco retailer or other establishment may sell, offer for sale or display tobacco products by self-service merchandising or any means besides vendor-assisted sales, unless the premises itself bars entry to anyone under 18. That carve-out means an 18-and-older adult store or bar can keep tobacco on open shelves; a general convenience store cannot.

Sec. 5-18 names the city manager as the enforcing official, with authority to designate subordinates to administer and secure compliance. Enforcement runs through Sec. 5-20: the enforcing official must serve written notice describing the violation location, the nature of the violation and the specific code section at issue, delivered to both the owner and any occupant if different, either by personal delivery or mail to the address on the tax rolls. The retailer then gets not less than five and not more than ten days to correct the display before further action.

The article's definition of 'tobacco products' covers only loose tobacco leaves and products made from tobacco leaves, plus cigarette wrappers, so it does not by its own terms reach e-cigarettes or vapor devices that do not contain tobacco leaf. A vape shop selling only nicotine e-liquid falls outside Sec. 5-17's display rule unless it also stocks tobacco-leaf products such as cigars or loose-leaf tobacco.
