Gilroy, CA Business Licensing & Operations: Adult Entertainment (2026)

The Gilroy City Council regulates sexually oriented businesses under Chapter 2A of the Gilroy City Code, covering adult bookstores, cabarets, theaters, arcades, escort agencies, figure modeling studios and similar uses. Section 2A.3 sets a strict 1,000-foot buffer: no adult business may be established within 1,000 feet of another adult business, a school, a public park or recreation area, a public building with programs for minors, a residential zone, or a religious institution, measured in a straight line between the nearest entrances or property lines. A business lawfully operating is grandfathered against a later-arriving school or church moving within that distance, but only for renewal of an existing use permit, not a fresh application after expiration or revocation.

Section 2A.8 makes clear no adult business may open by right in Gilroy: the operator must apply to the chief of police for an adult business permit and separately obtain a use permit under the Zoning Ordinance before the adult business permit becomes effective. Operational rules layered on top include an 8 a.m. to 1 a.m. curfew on performances, sales and services (Section 2A.7), a required on-site manager at all times (Section 2A.6), and access-and-control conditions barring locked doors during business hours and requiring interiors visible to code officers (Section 2A.5).
