The adult bookstores, adult cabarets and adult entertainment establishments governed by these provisions shall be allowable in the General Industrial (IG) District only... None of the uses governed by these provisions shall be allowed: (1) Within 1,000 feet of the boundary of any residential zoning district or any lot on which a dwelling unit is located. Town Code § 211-42 sets out the Town's adult-use spacing regime in detail. Subsection A states the legislative purpose: preventing concentration of these uses in any one area and lessening secondary effects including traffic and parking problems, loitering by transients, increases in criminal activity, loss of business by nearby nonadult commercial establishments, deterioration within residential neighborhoods and decreased property values. Subsection B confines every adult bookstore, adult cabaret and adult entertainment establishment to the General Industrial (IG) District only; no other zoning district in the Town permits these uses.

Subsection C caps the concentration further by barring more than one such use on any single lot townwide. Subsection D imposes three 1,000-foot buffers: from the boundary of any residential zoning district or any lot with a dwelling unit, from the property line of a school, church or other place of worship, day-care center, park or playground or other area where minors congregate, and from the property line of a lot containing another adult use. Subsection E requires the use to operate inside a fully enclosed building, and separately bars any display, decoration, sign, window or opening that would let a passerby see specified anatomical areas or specified sexual activity, regardless of distance. Subsection F makes a knowing violation prosecutable under the chapter's general penalty section, § 211-72.

A person who knowingly owns, manages, operates, conducts or maintains an adult use contrary to § 211-42 is subject to prosecution under § 211-72: up to $1,000 or six months for a first offense, $1,000-$5,000 for a second offense within five years, and $2,500-$10,000 for a third or subsequent offense within five years, with each week of continued violation a separate offense. The Town Board may also seek injunctive relief.
