Full Breakdown
330(A)(6) governs sexually oriented businesses as an additional development requirement layered onto the City's Zoning Code. It limits such businesses to one per 1,000-foot radius citywide and bars any sexually oriented business from locating within 1,000 feet of an educational or religious institution, a residential use, or a business that sells liquor. The owner/operator must submit to a police background check, and the Planning and Zoning Commission or City Council may impose reasonable hours-of-operation restrictions. ). All employees, performers, guests, customers and patrons must be at least 21 years old, and the business is barred from publicly displaying explicit sexual material, obscene items, or nudity visible from adjacent businesses or from a public or private street, sidewalk or trail.
519 separately confirms that location and distance regulation for businesses selling, leasing or providing pornography or obscene material runs through Chapter 400, the Zoning Code, rather than the general offenses chapter.
Violations & Fines
Operating a sexually oriented business without the required conditional use permit, or in violation of the spacing, age, or display restrictions, is a zoning violation. Because § 400.330 does not fix its own fine, the general penalty in § 100.010 applies (up to $500.00 and/or three months imprisonment per violation), and Missouri's zoning-violation penalty framework under Sections 89.120 and 89.490, RSMo. can also apply per § 100.010(A)(4).
