040(C), a property owner, lessee, or full-time property/security manager may authorize a towing company to remove abandoned or unauthorized-parking property only when that person is present, and only if the lot posts, at every entrance, a sign at least seventeen by twenty-two inches with lettering at least one inch tall warning of removal and disclosing the maximum towing and storage fees, plus a phone number to call. Absent that signed-lot authorization, an owner-occupied residential property of four units or fewer must notify police and wait ten hours before authorizing a tow, while other private property must notify police and wait ninety-six hours.

Whoever authorizes the tow must complete a state-form abandoned property report naming the vehicle, any damage, the towing company, and the tow operator's signature, and the towing company must deliver a copy to the Police Department within two hours for a signed lot or twenty-four hours otherwise. A towing company cannot remove property without the real property owner's written authorization except for vehicles blocking a fire hydrant within fifteen feet or a designated fire lane, and it must keep that written authorization on file for at least one year. 040(I).
