330(A)(5) as one of the uses requiring a conditional use permit because of its potential effect on nearby property. The core siting rule is a proximity buffer: no other such establishment 'shall be located within: (i) one thousand five hundred (1,500) feet of any other such establishment; or (ii) three hundred (300) feet of any structure primarily used as a State-licensed daycare facility or elementary school,' with distance measured in a straight line between the nearest points of the buildings involved. Beyond spacing, the code imposes several operating conditions: the owner or operator 'must submit to a police background check prior to the issuance of a business license,' the establishment must meet applicable City, County, and State health license standards, and its exterior and signage must be designed so the business does not detract from nearby businesses' ability to attract customers or hurt property values.

The code also bars alcohol entirely from these businesses: they may not sell, give away, or allow consumption of alcoholic beverages on the premises, are not eligible for a liquor license, and it is unlawful for any person to consume or use alcohol or marijuana-related products there.
