Operating conditions add more. All exterior doors must stay closed during business hours, nothing depicting specified sexual activities can be visible or audible from outside or from areas accessible to minors, and window displays are prohibited. Article 9-07 requires every such business to comply with the Article 8-02 business license and the sexually-oriented business license requirements, post a summary sign near the entrance, and keep a daily log of persons providing Adult Services covering the preceding twelve months.
Violations & Fines
Section 13-08-060 prints no penalty of its own, so Town Code § 1-08-010 applies. A violation is a class 1 misdemeanor, and each day it continues is a separate offense. Any Code violation is also a civil offense carrying a civil sanction not to exceed $2,500, counted per day.
