An adult bookstore is triggered once more than 15 percent of an establishment's floor area is devoted to sexually oriented books, videos, or paraphernalia; an adult entertainment establishment is one that features live performances involving specified sexual activities or specified anatomical areas on more than one day in a 30-day period.
2-404(c) requires it to sit at least 1,000 feet from any other adult use in any zoning district and at least 500 feet from a residentially zoned district, school, educational institution, place of worship, public park, playground, playfield, or day care center. The spacing test applies not only to a brand-new business but to the relocation of an existing adult use, an enlargement of its scope or floor area, or the conversion of any part of an existing business into an adult use. Because these uses are only permitted in limited zoning districts to begin with, the spacing rule functions as Roanoke's practical control on where such a business can obtain a zoning permit or certificate of occupancy in the first place.
Violations & Fines
Operating or expanding an adult use inside the 1,000-foot or 500-foot buffer without zoning approval is a zoning violation under Section 36.2-571. The Zoning Administrator issues written notice describing the violation, and continued noncompliance is a misdemeanor under Virginia Code Section 15.2-2286.A.5, with each day of the ongoing violation treated as a separate offense; the City can also seek an injunction to shut the use down.
