Summary
Any adult business operating in Wyandotte County, inside Kansas City, Kansas or in the unincorporated county, must hold an annual license from the Unified Government Board of Commissioners. Sec. 19-377 limits each license to one fixed location, running January 1 through December 31, and automatically revokes it the moment ownership or control of the business changes hands.
(a)From and after the effective date of the ordinance from which this article is derived, no adult business shall be operated in the county unless the owner or lessee thereof has obtained a license from the unified government board of commissioners. Each license shall be valid only from January 1 to December 31 of each calendar year.(b)A license may be issued only for one adult business, located at a fixed and certain place. Any person, partnership, or corporation which desires to operate more than one adult business must have a separate application and license for each.(c)No license or interest in a license may be assigned, sold, or transferred.(d)Transfer of ownership or control of an adult business shall automatically and immediately act as a revocation of the license.
Full Breakdown
Sec. 19-377 of the Unified Government Code makes it unlawful to operate an adult business anywhere in the county, including areas outside the city, without a license issued by the board of commissioners. The license is not a one-time approval: it expires every December 31 and must be renewed for the following calendar year, and it covers exactly one adult business at one fixed address, so an operator running two locations needs two separate applications and two licenses under Sec. 19-378. No license or any interest in it can be assigned, sold, or transferred, and Sec.
19-377(d) makes a change of ownership or control an automatic, immediate revocation rather than something the operator can wait out. Sec. 00, nonrefundable, for each entertainer, employee, masseur, or masseuse permit required under Sec. 19-380 before that person may work on the premises. Sec. , and requires that all public areas stay open to inspection by law enforcement, the county administrator, or a designee during business hours; refusing immediate access is itself grounds for suspension or revocation. Sec. 19-379 disqualifies an individual applicant who was convicted of or pleaded nolo contendere to a specified criminal act within the last five years for a felony or two years for a misdemeanor, or who was subject to a license revocation within the prior two years. All existing adult businesses located outside the city limits at the time the article passed had until December 31, 2005 to apply.
Violations & Fines
Operating or working at an unlicensed adult business is unlawful under Sec. 19-377(e), and Sec. 19-391 sets the penalty at up to one year in jail, a $2,500.00 fine, or both, prosecuted by the district attorney or, if not pursued there, in Kansas City municipal court. A licensee convicted under the article faces suspension or revocation, and any transfer of ownership automatically revokes the license the moment control changes without board approval.
