Section 17-8 of the Unified Government's Code of Ordinances defines 'tobacco product' broadly to cover cigarettes, cigars, chewing tobacco, hookah and any 'electronic smoking device,' including vape pens and e-cigars, plus components like rolling papers and filters. A 'tobacco retail establishment' is any place selling tobacco products to the public, from grocery stores and gas stations to bars and restaurants, meaning vape shops fall squarely under the ordinance rather than a separate vaping-specific license. Every tobacco retailer must verify age by examining a purchaser's government-issued photographic identification unless the retailer already knows the buyer is over 30; looking older than 30 is not a legal defense on its own.

Retailers cannot sell from self-service tobacco displays except where minors are barred from the premises entirely, and every store must post a sign stating cigarettes and tobacco products may be sold only to persons 21 and older. A. 53-601. Enforcement runs through the public health department, which uses fine revenue to fund unannounced compliance checks, inspections, and tobacco enforcement training. The transacting retailer, not necessarily the business owner, is treated as the violator for each sale.
