The following uses and activities shall not be conducted as a home occupation:
(a) Vehicle/Equipment repair;
(b) Beauty or barber shop;
(c) Restaurants/Catering;
(d) All Vehicle/Equipment Sales and Service Uses;
(e) Animal related services (animal boarding and training and animal grooming);
(f) Sexually oriented businesses
(g) The sale or storage of tobacco products, tobacco paraphernalia or alcoholic beverages;
(h) On-site commercial preparation of food for service on or off the premises (not including Cottage Food/Cosmetics Operations as defined in NRS 585); or
(i) Any type of business that HMC Title 4 would not permit to be operated out of a residential dwelling unit.
iii. No home occupation shall be allowed that is prohibited by the City of Henderson Building Code.
F. Moving Van/Truck Rental.
1. Definition. As a use accessory to a principal use on a site, the rental of pick-up trucks, vans, and/or box trucks specifically held out to be for use by people who are relocating their homes, businesses, etcetera.
2. Standards.
a. A maximum of four moving van/trucks for rent may be parked on site.
b. Trucks shall be limited to those 19 feet or fewer in length unless otherwise approved through a conditional use permit.
Full Breakdown
The Development Code lets residents run small home occupations under strict conditions, no employees, a 20% floor-area cap, appointment-only customers, but Subsection 19.9.3.E.2.f expressly carves vehicle work out of that allowance. 'Vehicle/Equipment repair' and 'All Vehicle/Equipment Sales and Service Uses' are listed among activities that 'shall not be conducted as a home occupation,' alongside barber shops, restaurants/catering, and animal boarding. A resident can't legally turn a garage into a repair bay or dispatch point for a mobile-mechanic business anywhere in a residential zone; that use has to locate in a district where Vehicle/Equipment Repair is a permitted or conditional commercial use.
Violations & Fines
Operating a home auto-repair business is a Development Code violation. HMC § 2.27.060 makes any Code violation a misdemeanor punishable by up to $1,000 and six months in jail, and each day it continues is a separate offense.
