Wichita's zoning code lists Vehicle Repair, General and Vehicle Repair, Limited among the uses a home occupation license can never cover in ordinary residential districts. Fixing cars from a home garage for pay is banned citywide unless the property is a two-acre-plus lot in the RR or SF-20 rural districts and qualifies as a rural home occupation under Sec. IV-E.7 and IV-E.8.

Full Breakdown

Under the Wichita-Sedgwick County Unified Zoning Code's home occupation standards (Article IV, Sec. IV-E), a business run out of a house is regulated as an Accessory Use, but Sec. 6 flatly excludes Vehicle Repair, General and Limited from the uses that can qualify, alongside Animal Care, Bed and Breakfast Inns, contractor's storage, funeral homes, kennels, and restaurants, unless the exception in Sec. 8 applies. That exception exists only for rural home occupations, a narrower category available solely to lots zoned RR (Rural Residential) or SF-20 that sit on a public road and contain at least two acres, per Sec.

7. A rural home occupation must also sit at least 75 feet from any off-site residence, may use an accessory structure up to the size of the main house or 3,000 square feet, whichever is greater, and can employ up to the equivalent of four full-time workers. Within that rural carve-out, Sec. e specifically permits vehicle repair, limited and general, but general repair work, meaning painting or body work, must happen entirely inside an enclosed structure; limited repair, such as tune-ups, brakes, or tires, may be done outdoors as a rural home occupation.

Everywhere else in the city, including standard single-family SF-5 and SF-10 zoning, operating any paying vehicle repair business from a house, garage, or driveway sits outside the home occupation rules entirely, no matter how small the operation is. A homeowner who wants to run a repair shop from a standard residential lot has no path to a home occupation permit for it; the only routes are relocating to a commercially or industrially zoned property or qualifying for the rural exception on a large RR or SF-20 parcel.

The Zoning Administrator enforces the Unified Zoning Code, and a use found operating in violation of the home occupation standards is subject to the City's zoning enforcement process.

Violations & Fines

Running a vehicle repair business from a home outside the RR/SF-20 rural home occupation exception is a zoning violation, not merely a licensing gap. The Zoning Administrator can order the use discontinued, and Wichita's zoning enforcement provisions authorize citations, fines, and, if uncorrected, prosecution for maintaining a use that violates the Unified Zoning Code. Continuing noncompliance can also block issuance of any future home occupation license for the property.

Frequently Asked Questions

Can I fix cars for pay in my Wichita garage?
Not as a standard home occupation. Wichita-Sedgwick County Unified Zoning Code Sec. IV-E.6.b specifically excludes Vehicle Repair, General and Limited from the uses a home occupation license can cover, so a typical residential lot cannot host a paying auto repair business, even one confined entirely to the garage.
Is there any way to legally repair vehicles at a Wichita home?
Yes, but only as a rural home occupation on a lot zoned RR or SF-20 with at least two acres, per Sec. IV-E.7 and IV-E.8.e. Limited repair work like tune-ups or tire changes may be done outdoors; general repair, such as body or paint work, must occur entirely inside an enclosed structure.
How close to a rural home occupation vehicle repair site can a neighbor's house be?
Sec. IV-E.7.b requires the rural home occupation to sit at least 75 feet from any residence located off-site from the property, unless that neighboring residence also operates a rural home occupation.
What happens if I run an auto repair shop from an ordinary Wichita residential lot?
It is a zoning violation. The Zoning Administrator can require the use to stop, and the city can pursue citations or civil penalties under its zoning enforcement authority for maintaining a use the Unified Zoning Code does not allow at that location.
