Full Breakdown
The Wichita-Sedgwick County Unified Zoning Code regulates tattoo and body piercing studios as a supplementary use under Sec. ee rather than through a separate city health permit: the general code's old sanitary-inspection chapter for tattooing, body piercing and permanent cosmetics, former Sec. 090, was repealed by Ord. No. 52-051, § 2, adopted March 21, 2023, leaving the zoning standard as the operative city-specific rule. Under Sec. ee, every Tattooing and Body Piercing Facility within the City must locate in the GC (General Commercial), OW (Office Warehouse), IP (Industrial Park), LI (Limited Industrial), GI (General Industrial) or AFB (Air Force Base) zoning district, no closer than 200 feet to a school, park, or any residential zoning district, measured from the nearest lot lines of each, including the patron parking area if it sits closer than the building itself.
All tattooing and piercing must be performed inside an enclosed building; outdoor work is not allowed. m. The zoning code also treats tattoo and body piercing facilities differently depending on where in the region they sit: Sec. j expressly excludes Tattooing and Body Piercing Facilities (City) from the uses a home occupation license can cover inside Wichita's city limits, so operating a tattoo studio out of a house is not permitted, while the parallel Sec. j allows a Tattooing and Body Piercing Facilities (County) home occupation on unincorporated Sedgwick County land.
A. 65-1940, is conducted, tying the local locational rule to the state's underlying sanitation statute. The Zoning Administrator enforces placement and district compliance through the standard zoning permit and inspection process.
Violations & Fines
Operating a tattoo or body piercing facility outside the permitted GC, OW, IP, LI, GI or AFB districts, within 200 feet of a school, park or residential district, or as a home-based business anywhere in the city violates the Unified Zoning Code. The Zoning Administrator can order the use discontinued and pursue the City's standard zoning enforcement remedies, including citations and civil penalties, for maintaining a use the Code does not allow at that location.
