Summary

Littleton has no separate secondhand-dealer business license, but City Code Section 6-4-155 requires every secondhand dealer who buys, sells, rents or exchanges a weapon to log the transaction and the customer's identifying details in a book open to police inspection at any time.

A. Every secondhand dealer, pawnbroker or other person engaged in the sale, rental or exchange of any weapons described hereinabove, shall keep a record of each such weapon purchased, sold, rented or exchanged at retail. Such record shall be made at the time of the transaction in a book kept for that purpose and shall include the name of the person to whom or from whom such weapon is purchased, sold or rented, or with whom exchanged; his age, physical description, occupation, residence and if residing in a city the street and number where he resides; the make, caliber and finish of the firearm together with the number or serial letter thereof, if any; the date of the purchase, sale, rental or exchange of such weapon and the name of the employee or other person making such purchase, sale, rental or exchange. B. Such record shall be open at all times to the inspection of any duly authorized police officer of the city.

Full Breakdown

Littleton does not run a stand-alone licensing chapter for general secondhand or junk dealers the way it does for pawnbrokers under the firearms retailer chapter. Instead, Section 6-4-155 of the City Code imposes a narrower, weapons-specific record-keeping duty on every secondhand dealer, pawnbroker or other person engaged in the sale, rental or exchange of a weapon covered by the preceding sections of Chapter 4's weapons article. For each weapon purchased, sold, rented or exchanged at retail, the dealer must make a record at the time of the transaction in a book kept for that purpose, recording the name of the person the weapon was purchased from, sold to, or exchanged with; that person's age, physical description, occupation and residence address; the weapon's make, caliber, finish and serial number if it has one; the date of the transaction; and the name of the employee who handled it.

Subsection (B) requires that record book to be open at all times to inspection by any duly authorized Littleton police officer, with no advance notice requirement. The same chapter separately bars any secondhand dealer from displaying a handgun, revolver or other firearm with a barrel under twelve inches, or any illegal weapon, in a show window facing a street (Section 6-4-154(B)). A secondhand dealer who also happens to be a pawnbroker is additionally swept into the Chapter 24 firearms retailer license requirement, but a secondhand dealer that is not a pawnbroker faces only the Section 6-4-155 records duty, not a license.

Violations & Fines

Failing to keep the transaction records required by Section 6-4-155, refusing a police officer's inspection of the record book, or displaying a prohibited firearm in a window under Section 6-4-154(B) is punished under the city's general penalty, Section 1-4-1: a fine of up to $2,650, up to 364 days in jail, or up to a year of probation.

Frequently Asked Questions

Does Littleton require secondhand dealers to have a business license?
Littleton's City Code has no stand-alone secondhand-dealer license chapter. It does require, under Section 6-4-155, that every secondhand dealer keep a detailed transaction record for any weapon bought, sold, rented or exchanged, open to police inspection at all times.
What information does a Littleton secondhand dealer have to record about a weapon sale?
Under Section 6-4-155(A), the dealer must log the other party's name, age, physical description, occupation and residence address, along with the weapon's make, caliber, finish and serial number, and the date of the transaction and employee who handled it.
Can a secondhand dealer in Littleton display a handgun in the store window?
Not if the barrel is under twelve inches or the weapon is illegal. Section 6-4-154(B) bars any secondhand dealer or pawnbroker from displaying such a firearm in a show window facing a street.
