Lehi, UT Business Licensing & Operations: Tobacco Retail License (2026)

Lehi City Code § 5-5-5 authorizes the Utah County Health Department, or its designee, to conduct random unannounced inspections at any location where tobacco products are distributed, with compliance checks allowed up to twice a year absent reasonable suspicion of underage sales. Section 5-5-6 lays out a graduated civil penalty schedule against the store owner: $500 for a first violation, $750 for a second within 12 months, and $1,000 or up to a 30-day tobacco permit suspension for a third violation within 24 months of two prior violations.

A fourth violation within 24 months of three prior violations exposes the retailer's tobacco permit to outright revocation, and the Health Department must suspend the permit if any violation involves a sale to a person under 19. 6 or 17-50-333. Separately, criminal citations against the individual clerk who sold the product escalate from a class C misdemeanor on a first offense up to a class A misdemeanor on a third or later offense under § 5-5-6(A). This licensing-enforcement structure was adopted by Ordinance 15-2019 on February 12, 2019, and defines 'tobacco product' and 'electronic smoking device' broadly enough to cover vape pens, e-cigars and e-hookahs.
