Milpitas, CA Business Licensing & Operations: Tobacco Retail License (2026)

Milpitas' Zoning Ordinance defines a Smoke/Tobacco Shop as a retail establishment 'primarily engaged' in selling smoking and tobacco products, including cigarettes, cigars, loose-leaf tobacco, pipes, electronic smoking devices, vaporizers and related accessories, and sets that threshold at 30 percent or more of the store's total retail sales (Chapter E.4, Definitions of Uses). A retailer that clears that 30 percent line is classified as a Smoke/Tobacco Shop for zoning purposes, not as ordinary retail. Table B.6.020-A (Commercial Zones Use Regulations) controls where the use can locate.

It is not allowed at all in the CO Administrative and Professional Office Zone, and it requires a full discretionary Conditional Use Permit, reviewed under Subsection D.4.030 (Use Permits), in the C1 Neighborhood Commercial, C2 General Commercial and HS Highway Services zones. A second table, B.8.020-A, blocks the use entirely in the MXD and MXD3 mixed-use zones but allows it with a Conditional Use Permit in the NCMU and TC zones. The Planning Commission, or the Zoning Administrator for a minor permit tier elsewhere in the code, must find the shop will not create adverse impacts before approval, and can attach operating conditions such as hours or signage limits.

There is no separate city business license specific to tobacco sales; a Smoke/Tobacco Shop still needs the citywide business license required of every business under Title III, Chapter 1, in addition to the zoning entitlement. Planning and Neighborhood Services processes the Conditional Use Permit application, and Code Enforcement within that department investigates a shop operating without one.
