Milton, WI Business Licensing & Operations: Tobacco Retail License (2026)

Milton Code of Ordinances Sec. 14-71 bars any person from directly or indirectly manufacturing, selling, exchanging, disposing of, giving away, or keeping for sale any cigarettes or tobacco products without first obtaining a license from the city clerk in the manner Wis. 65 provides. The article carves out an exception for jobbers or manufacturers doing interstate business with customers outside Wisconsin. Sec. 14-72 requires payment of a fee to the clerk before the license issues, with the common council setting the fee amount by resolution requiring a majority vote of members present, and the clerk maintaining a current fee schedule.

Sec. 14-73 requires the license to be signed by the clerk, to name the licensee and the authorized place of business, and to expire each year on June 30 following issuance, meaning every retailer must renew annually rather than hold a permanent license. Sec. 14-74 ties enforcement to state law directly: the penalty for violating any provision of the tobacco article is whatever Wis. 65(5) provides, rather than the city's own general forfeiture schedule. Separately, Sec. 50-194 adopts Wis. 92 as local law governing possession and use of tobacco products and electronic delivery devices, defined broadly to include e-cigarettes, e-cigars, e-pipes, e-hookahs and vape pens, by minors under 18, with violations by a minor handled through the municipal court's forfeiture process under Sec.

1-4. That youth-access provision regulates possession and purchase by minors; it does not create a separate retail licensing track for vapor products, so a vapor product retailer in the City of Milton is licensed the same way as any other tobacco retailer under Sec. 14-71.
