New Britain, CT Business Licensing & Operations: Tobacco Retail License (2026)

The Zoning Ordinance's definitions section defines SMOKE SHOP OR TOBACCO STORE as a retail establishment dedicated to the sale of tobacco and products containing tobacco or nicotine, including e-cigarettes, and paraphernalia, along with any area for consuming smokeable products; cannabis and marijuana sales are explicitly excluded unless separately licensed by the city and state. That definition folds vape and e-cigarette retailers into the same spacing rule that governs traditional tobacco stores. Section 230-230-10, approved December 18, 2024 (Item #36632-3), then sets the actual distance standard: no smoke shop or tobacco store may locate within a three-thousand-foot radius of any other such store or of a cannabis dispensary, cannabis retailer, or hybrid retailer, and no such store may sit within one hundred feet, along the same street front, of a residential district, a public or private elementary or high school, or a religious institution.

Because the definition already captures e-cigarette and vape retailers, a prospective shop cannot avoid the spacing rule simply by branding itself as a vape store rather than a tobacco store. The rule applies on top of whatever state tobacco or nicotine retail registration Connecticut requires; the city's zoning permit is denied if the location fails this distance test, regardless of state paperwork. The Director of Licenses, Permits and Inspections administers zoning permits under Section 280-30-10 and can refuse or revoke one that does not meet the spacing standard.
