Section 14-61, enacted by Ord. No. 91-173 in 1991, governs non-consent towing from private property within the City of Lauderhill, applying to any owner or lessor of private real property, or an authorized representative such as a condominium association, who has a vehicle removed by a licensed towing firm without the vehicle owner's permission. The section operates alongside Florida Statute 715.07 and sets its own dollar caps that a towing company may not exceed regardless of the type of removal or the vehicle's destination: no more than $60 combined for the towing and removal charge, no more than $15 per vehicle for each 24-hour period of storage regardless of the storage facility's location, and a single administrative fee of no more than $25 per vehicle, chargeable only after three full storage days have passed without the vehicle being claimed.

If the registered owner recovers the vehicle after it is hooked to the tow truck but before towing begins, the company may charge only half of the towing rate. Every licensed towing firm operating in the city must register with the Lauderhill Police Department, under Chapter 17 of the Code, the name and phone number of an agent authorized to release towed vehicles and the storage facility's claiming hours, and must adopt and prominently post guidelines for accepting checks and credit cards. Towing companies must also post, at every location where towed vehicles are held, a copy of Section 14-61 itself and a copy of Florida Statute 715.07.

Any individual or corporation that violates the section is guilty of a municipal violation punishable by a fine of up to $500, imprisonment for up to 60 days, or both, with each violation charged separately.
