Full Breakdown

Section 42.6.D.1.a of the New Haven Zoning Ordinance sets two distance floors for cannabis establishments citywide. No cannabis establishment use may locate within 500 feet of the property line of any public, parochial, or private elementary or secondary school. Separately, dispensary facilities, retailers, hybrid retailers, and tobacco/cannabis bars may not locate within 1,500 feet of another cannabis establishment of that type. Distance is measured property line to property line, or from the main public entrance if the building exceeds 50,000 square feet. Delivery services, transporters, producers, cultivators, and product packagers are not subject to the 1,500-foot spacing rule.

Violations & Fines

No cannabis establishment permit or certificate of zoning compliance issues for a site inside the buffer; the Zoning Enforcement Officer can order a noncompliant use closed.
