New Haven has not opted out of cannabis retail: delivery and transport are allowed by right, while producers, cultivators, retailers, and dispensaries need a City Plan Commission special permit in business and industrial zones.

Under Section 42.6.C of the New Haven Zoning Ordinance, cannabis delivery services and transporters are allowed as of right in the BA, BA-1, BA-2, BB, BC, BD, BD-1, BD-2, BD-3, BE, CGD, IL, and IH zones. Producers, dispensary facilities, cultivators, micro-cultivators, retailers, hybrid retailers, food and beverage manufacturers, and product packagers need a City Plan Commission special permit in those same zones. No more than one licensed retailer is allowed per 25,000 city residents. Cannabis establishments are banned outright in every residence district, in the IM, Park, Cemetery, and Airport districts, and in three named overlay districts.
Violations & Fines
Operating without the required special permit, or outside an eligible business/industrial zone, is a zoning violation subject to a cease-and-desist order and jeopardizes the establishment's state cannabis license.
