(a)Location. No cultivation center or adult-use cannabis business establishments except adult-use dispensary, adult-use craft grower, adult-use cannabis transporting organization, adult-use cannabis processing organizations and adult-use cannabis infuser organization shall be located within 1,000 feet of the property line of a pre-existing public or private pre-school or elementary or secondary school or day care center, day care home, group day care home, part day care facility, or an area zoned for residential use...(b)Setback from other cultivation centers, dispensaries, and adult-use cannabis business establishments. No cultivation center or adult-use cannabis business establishments, except adult-use dispensary, adult-use craft grower, adult-use cannabis transporting organization, adult-use cannabis processing organization, and adult-use cannabis infuser, may be located within 1,500 feet of another cultivation center, dispensary, or adult-use cannabis business establishment absent demonstration of a variance provided by the Illinois Department of Agriculture or the Illinois Department of Financial and Professional Regulation.

Sec. 496(a) keeps cultivation centers, craft growers, processors, and infuser organizations at least 1,000 feet from the property line of a pre-existing public or private preschool, elementary or secondary school, day care center or home, or any area zoned residential, measured as the shortest straight-line distance between property lines; adult-use transporting and infuser organizations get a narrower 500-foot version of the same buffer. This school/residential buffer generally cannot be varied, though an adult-use establishment (not a cultivation center) can get up to a 50% reduction where a four-lane divided highway, an active double-track railroad, or a 150-foot-wide body of water without a bridge separates the sites, or up to 15% for another qualifying physical condition.
Sec. 496(b) additionally keeps any cannabis business establishment at least 1,500 feet from another one, absent a variance granted by the Illinois Department of Agriculture or Department of Financial and Professional Regulation. Dispensaries are governed separately under Sec. 497(a): a 1,000-foot buffer from schools, day cares, churches and parks (not just schools and residential zones), plus a 1,500-foot dispensary-to-dispensary buffer in the B-1, B-2, I-1 and I-2 districts, or a 1,000-foot buffer in the S-3 district; medical dispensaries licensed before July 1, 2019 are grandfathered out of these distance rules. Petitions for the conditional permitted use go to the city zoning administrator under Sec. 495.
