Waynesville, MO Cannabis Regulations: Buffer Zones (2026)

Section 405.674 sets the buffer for every category of marijuana facility the City of Waynesville zones for: dispensaries, infused-products manufacturing, cultivation and testing. A dispensary cannot sit within 300 feet of a school, a licensed child day-care center or a church that is then existing, meaning it already holds a City building permit, is under construction, or is completed and in use at the time the dispensary first applies for a zoning or building permit. Measuring is precise: for a free-standing dispensary, the distance runs from the closest exterior wall of the facility to the nearest point of the protected use's property line; for a dispensary inside a larger structure such as an office building or strip mall, the measurement runs instead from the property line of the school, daycare or church to the facility's nearest entrance or exit, and always along the shortest path a person could walk between the two points.

Marijuana-infused products manufacturing facilities that use combustible gases or CO2 in extraction get the identical 300-foot buffer; facilities that avoid combustible extraction may locate anywhere a dispensary could. Cultivation facilities and testing facilities carry the same 300-foot buffer and the same walking-distance measurement rule, and both must sit within an enclosed building, with cultivation additionally confined to the I-1, I-2 Industrial and MU-2 Mixed Use Districts. Every category also requires the state-issued license to be displayed prominently on site and bars any onsite consumption of marijuana. A facility sited inside the buffer, or operating without meeting these zoning standards, is enforced through Chapter 405's general zoning penalty at § 405.740.
