Full Breakdown
Bloomfield Township opted in to retail cannabis through Ord. No. 21-31, adopted 8-16-2021, which added § 315-39B(9) to the Land Development and Zoning chapter. The rule is narrow. Cannabis cultivators, distributors, manufacturers, wholesalers and delivery services are not permitted in any zoning district. Cannabis retailers are permitted conditional uses in the CBD Central Business District and the B-2 Neighborhood Business District. Cannabis retail sales are also a permitted use in the Bloomfield Center Redevelopment District Phase I Commercial Corridor and the Phase II district, under a different regulatory scheme, although the numerical limits and submission requirements still apply there.
The Code describes 11 noncontiguous B-2 Zones and three noncontiguous CBD Zones. A total of eight cannabis retailers are permitted throughout the Township: no more than four in the Northern Sector, no more than four in the Central Sector, and no more than four in the Southern Sector, split by Bay Avenue and the Norfolk-Southern Railway Line. No variance can raise the number of retailers or microbusinesses, in the Township or in any sector. Only an amending ordinance can increase the cap.
Every retailer needs site plan review before personal use sales begin. The application must include a resolution of support from the governing body, a security plan approved by the Bloomfield Police Department, and proof of conditional or annual license approval by the state Cannabis Regulatory Commission. The resolution of support cannot be transferred to a successor operator or to another site.
The conditional use standards in § 315-39B(9)(e) add parking at the ratio of one space per 150 square feet of customer service area, all on site, and an exterior queuing area located at least 10 feet from any public right-of-way. Consumption areas and drive-through service are prohibited, and no cannabis products can be visible from outside the building. Retail also cannot share premises with a food store or a store selling alcoholic beverages.
Violations & Fines
Under § 315-39B(9)(h), operating a prohibited or unpermitted cannabis business in violation of § 315-39B(9) is declared a public nuisance and is abated under all available remedies, with enforcement tied to Article VIII of Chapter 315. Section 315-53A lets the Zoning Officer and Construction Official assess administrative penalties and issue stop-work orders, and § 1-15A sets fines up to $2,000. The Township also reserves a right to inspect an approved dispensary during regular hours.
