Eagle Mountain, UT Cannabis Regulations: Dispensary Zoning (2026)

Chapter 17.51 was adopted to let large-scale farming and cultivation operate inside enclosed structures with a reasonable buffer from housing. EMMC 17.51.010 restricts the overlay to agricultural and industrial zones defined in Chapters 17.20 and 17.40, and expressly bars it from abutting or adjoining any residential zoning district under Chapter 17.25. EMMC 17.51.020 defines a "cannabis production establishment" as a person or facility that grows or intends to grow cannabis and holds a valid cannabis cultivation facility license issued by the state of Utah under Title 4-41a, Utah Code Annotated, so the city relies on the state license rather than issuing its own cultivation permit.

EMMC 17.51.030 then lists the cannabis production establishment or cannabis cultivation facility as a permitted use inside the overlay, on top of whatever the underlying zone already allows, subject to the standards in EMMC 17.21.060. The chapter governs growing only, not retail sale: EMMC 17.51.050(C) layers on cultivation-specific standards for any cannabis production establishment, including full compliance with state regulations, a single secure public entrance, a backed-up security system that alerts law enforcement to unauthorized entry, locked storage areas for cannabis and cannabis product, signage limited to the establishment's name, hours and a green cross under Chapter 17.80, and odor-control ventilation strong enough that odors cannot be reasonably detected at the property line.
